Welcome to Requip Market. These Terms of Service ("Terms") govern your use of the Requip Market website, platform, and services (collectively, the "Service") operated by Requip Market ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By creating an account, browsing listings, or otherwise using Requip Market, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. What Requip Market Is (and Isn't)

Requip Market is a marketplace platform that connects buyers and sellers of used and refurbished production and manufacturing equipment. Here's what that means:

• We are a connector, not a party to transactions. Requip Market provides the platform where buyers and sellers find each other. We do not own, inspect, warehouse, or ship any equipment listed on the platform.
• We do not guarantee outcomes. Requip Market takes no responsibility for the quality, safety, legality, or accuracy of any listing, equipment, or transaction — whether the outcome is good or bad.
• Transactions are between you and the other party. Any purchase, sale, negotiation, or agreement is strictly between the buyer and seller. We are not involved in pricing, payment terms, shipping arrangements, or dispute resolution between parties.

By using this platform, buyers and sellers agree to not hold Requip Market responsible or liable for any outcomes resulting from transactions, interactions, or communications conducted through the Service.

3. Fraud, Scams & Impersonation Warning

Please exercise caution. As with any online marketplace, there is a risk of fraud, scams, and impersonation. While we take reasonable steps to promote a trustworthy environment (including seller verification and admin moderation), we cannot guarantee that every user or listing is legitimate.

You should:

• Verify the identity of the person you are dealing with before sending money or equipment
• Be skeptical of deals that seem too good to be true
• Never share sensitive personal or financial information outside of secure, established channels
• Report suspicious activity to us immediately at [email protected]

Requip Market is not liable for losses resulting from fraud, scams, impersonation, or misrepresentation by other users. By using the Service, you acknowledge and accept this risk.

4. User Accounts & Responsibilities

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Keep your account credentials secure and confidential
• Notify us promptly if you suspect unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

You may not use the Service to:

• Post false, misleading, or fraudulent listings
• Impersonate another person or business
• Harass, threaten, or abuse other users
• Violate any applicable law or regulation
• Attempt to circumvent platform security or access controls

5. Listings & Transactions

For sellers: You are solely responsible for the accuracy and completeness of your listings, including descriptions, photos, pricing, condition, and availability. You represent that you have the legal right to sell any equipment you list.

For buyers: You are responsible for performing your own due diligence before making any purchase. This includes verifying equipment condition, specifications, and seller legitimacy. Requip Market does not inspect, certify, or warrant any equipment.

For both: Requip Market does not mediate disputes between buyers and sellers. We encourage both parties to communicate clearly, document agreements, and use secure payment methods.

6. Intellectual Property

The Requip Market name, logo, design, and original content are our property and are protected by applicable intellectual property laws. You may not use our branding without written permission.

By posting content (listings, photos, descriptions) on Requip Market, you grant us a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that content solely for the purpose of operating and promoting the Service. You retain ownership of your content.

7. Payment Processing

Requip Market partners with Stripe for payment processing. When you make a payment through our platform:

• We do not store your credit card information. All payment data is handled directly by Stripe's secure, PCI-compliant infrastructure.
• Your use of Stripe's services is subject to Stripe's Terms of Service and Stripe's Privacy Policy.
• For any payment, billing, or merchant-related issues, please contact Stripe directly.

Requip Market is not responsible for payment processing errors, disputes, or issues handled by Stripe.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any content or listings on the platform.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Requip Market and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to Requip Market (if any) in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Requip Market and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you post or submit through the Service
• Any transaction between you and another user

11. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable.

You may delete your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately, though certain provisions of these Terms (including Sections 2, 3, 8, 9, 10, and 12) will survive termination.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Michigan, and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Effective Date" at the top of this page and, where appropriate, notify you via email or a notice on the platform. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
